Who Can Get an MD-42 License in India? Full 2026 Eligibility Guide for Medical Device Sellers & Distributors

If you’re a pharmacy owner, wholesaler, distributor, e-commerce seller, or anyone planning to stock and sell medical devices in India, you’ve probably heard about the MD-42 license. Today we’re breaking it down clearly: What exactly is an MD-42 license? Who is eligible? And what do you actually need to qualify?

This is the exact info every medical device business in India needs right now in 2026.

What is the MD-42 License?

The MD-42 is the official Registration Certificate issued by your State Licensing Authority (SLA). It legally allows you to sell, stock, exhibit, offer for sale, or distribute medical devices — including In-Vitro Diagnostic (IVD) devices — across India.

It came into force through the Medical Devices (Fifth Amendment) Rules, 2022 (notified on 30 September 2022). Since then, it’s mandatory for anyone in the distribution chain who doesn’t already hold a manufacturing license or an old drug wholesale license (Form 20B/21B).

In simple terms: No MD-42 = you cannot legally sell or stock medical devices in India anymore.

Who is Eligible for MD-42 License? (Exact Eligibility Criteria)

Here’s the straightforward answer — you are eligible if:

  • You are a retailer (medical shop, pharmacy, optical store selling contact lenses, BP monitors, thermometers, etc.)
  • You are a wholesaler or distributor supplying hospitals, clinics, or other retailers
  • You run an e-commerce platform selling medical devices on Amazon, Flipkart, or your own site
  • You operate a hospital procurement unit, diagnostic chain, or stockist handling devices in bulk
  • You are an importer who wants to distribute devices locally in India

Important note: This license is only for sale, stocking, and distribution — not for manufacturing. Manufacturers need separate licenses (MD-5, MD-9, etc.).

Every separate business location needs its own MD-42. One license per shop, warehouse, or godown.

Key Requirements You Must Meet to Qualify

To get approved, your application must tick these boxes:

  1. Premises Requirements
    • Dedicated storage space (minimum 15–20 sqm recommended)
    • Proper shelving, temperature control, and cold chain facilities where needed
    • Clean, hygienic, and separate from residential areas
  2. Competent Technical Staff (CTS) – This is NON-NEGOTIABLE You must appoint at least one qualified person who is:
    • A registered pharmacist, OR
    • Holds a degree from a recognized university/institution, OR
    • Has passed intermediate (12th) with at least 1 year of experience in selling or handling medical devices
  3. Other Documents You’ll Need
    • Business registration (GST, shop & establishment, company incorporation)
    • Proof of premises (rent/ownership agreement + layout plan)
    • ID & address proof of proprietor/partners/directors
    • Declaration on Form MD-41
    • Fee payment challan

How Long Does the License Last?

Once issued, the MD-42 registration is usually valid for 5 years. You pay retention fees to keep it active.

Pro Tip for 2026

If you’re in Uttar Pradesh (like many of our viewers), you apply through the Uttar Pradesh State Licensing Authority under the Drugs Control Department. The process is now mostly online via the state portal or CDSCO’s SUGAM system.

Start early — inspections and approvals can take 30–90 days depending on your state.

Bottom line: If you sell, stock, or distribute any medical device in India — from bandages to advanced diagnostic kits — the MD-42 license is now your legal must-have. Skip it and you risk heavy penalties, product seizures, or business shutdown.
